These terms for services (“Terms”) apply to Services provided by Podspace AB, (Corp. ID 556991-4046), Skeppargatan 65, 114 59 Stockholm, Sweden (“Podspace”) and subscribed to by clients (“Users”/”You”), through the website https://podspace.com, (the “Website”), email or through any other kind of contact with Podspace.
Podspace helps individual creators and major production companies to distribute audio media content to listeners. Podspace supports the large platforms that the majority of listeners choose when they consume audio media, such as, Apple Podcasts, Spotify, Google Podcasts and more. We are happy that you want to use our services and do not hesitate to contact Podspace Support if you have any questions or ideas how we can improve our services.
Advertisement Services” refers to the services “Podspace Campaign Manager” and “Podspace Ads Manager”.
“Agreement” refers to the Parties’ written agreement concerning Podspace’s provision of Services, and includes the Agreement Specification, if applicable, and these Terms. The Agreement can be concluded through the creation of a User Account, where these Terms are accepted, as well as through written correspondence between the Parties such as email.
“Agreement Specification” refers to the order confirmation, the main document, or the Customer’s acceptance of Podspace’s offer, to which these Terms form an appendix, and where the Services to be provided by Podspace under the Agreement are described.
“Agreement Term” refers to the term of the Agreement as specified in the Agreement Specification, or when not specified in the Agreement Specification, in the Terms.
“Confidential Information” refers to all information concerning the contents of the Agreement and other information the Parties have received in relation to the co-operation or the Agreement, regardless of whether the information is provided in writing or verbally, and irrespective of format.
“Defects or Deviations in the Services” shall have the meaning of any substantial deviations in the Services that has a severe impact on the User.
“General Provisions” refers to the provisions set out in sections 1-23 of these Terms, which apply to all Agreements between the Parties.
“Intellectual Property Rights” refers to copyright, rights to patents, designs, trademarks and databases, rights to registered company names, trade names and other business names, including all registrations and applications for registration, and rights to trade secrets, know-how, source codes and other technical information.
“New Development” refers to any alterations, improvements, additions, changes or removal of any function of the Services.
“Parties” refers to the User and Podspace collectively.
“Party” refers to any of the individual parties, e.g. the User or Podspace.
“Podspace Ads Manager” refers to ****the feature to add advertisement(s) to the User Content by the User via the User Account.
“Podspace Campaign Manager” refers to the feature to upload sponsorship content dynamically by the User to the User Content via the User Account.
“Services” refers to the hosting, storage and distributions of User Content that the User can subscribe to by creating a User Account through the Website, as well as statistics and listening data provided by Podspace to the Users.
“Special Provisions” refers to Special Provisions for Advertisement Services.
“Special Provisions for Advertisement Services” refers to the provisions set forth in sections 24 – 27 below, where the respective sections, in addition to the General Provisions, only applies if the User subscribes to any of the Advertisement Services that are regulated by the sections concerned.
“User Account” refers to the account that the User can create on the Website in order to get access to the Services and the Advertisement Services.
